    Immigration Worksite Compliance 

    The current Presidential Administration has made immigration enforcement a top priority and this includes worksite enforcement. Immigration has quintupled the number of I-9 audits that it conducts and has returned to a policy of conducting raids at employer’s worksites.

    The proper completion, correction, maintenance and destruction of an employer’s Form I-9s (Employment Eligibility Verification Form) has never been more critical than it is now. In the past few years, Immigration and Customs Enforcement (“ICE”) has begun the random inspection of Form I-9s and has been imposing substantial sanctions for violations. Each year, ICE increases the number of random audits it conducts and re-audits companies it has previously audited.

    Most I-9 audits find numerous violations in an employer’s Form I-9s because personnel completing the Form I-9 are unaware of many of the statutory requirements. In addition, E-Verify adds another level of compliance that employers must make sure they are handling properly. With fines for I-9 paperwork violations as high as $1,862 per Form I-9 for a first offense, and fines for other immigration compliance violations equally as formidable, employers need to review their compliance policies, before they are the subject of an investigation.

    Ms. Bollman will review the hot topics in Form I-9 compliance and provide practical tips and strategies for reducing exposure and eliminating fines in an ICE I-9 audit as well as guidance on how to properly prepare for ICE I-9 audit.

    About the Speaker Patricia A. Bollman is a 1986 graduate of Tulane University School of Law. For over thirty years Ms. Bollman has practiced primarily in the area of immigration and nationality law. A significant portion of Ms. Bollman’s immigration law practice is in the area of employment-based immigration matters. Ms. Bollman has developed an expertise in I-9 compliance issues and regularly conducts I-9 training seminars, which she teaches to HR and Personnel staff for businesses of all sizes and industries. Ms. Bollman has spoken at law schools and for professional and public groups on employment-based immigration visas and I-9/E-Verify compliance procedures.

    Ms. Bollman is a member of the American Immigration Lawyers Association.
